Nursing Home Blocks Sexual Assault Investigation

Nursing Home Blocks Sexual Assault Investigation – A Volusia County nursing home located in Tallahassee, Florida is now blocking local law enforcement officials from investigating an alleged rape of one of its elderly female residents.  Last week, Daytona Beach Health & Rehabilitation Center and its parent company NHS Management impeded a criminal investigation after a 75-year-old resident’s daughter reported that her mother was sexually assaulted.  The 75-year-old resident recently tested positive for a sexually transmitted disease.

Unfortunately, this case is not unique.  Sexual assaults occur in nursing homes.  Understaffing/low staffing levels and failure to do required background checks make nursing home residents easy targets.  Nursing homes are required to conduct federal background checks on all workers, however, the California State Office of Inspector General recently found that many nursing homes are not doing the required background checks or training of caregivers.

If you or a loved one has been the victim of a sexual assault in a nursing home or assisted living facility and would like to make a complaint and have your case investigated, please contact York Law Firm at 916-643-2200.   We are dedicated to representing elders and dependent adults who have been injured, neglected, or abused.
